Daniel Giersch (pictured above) is the 2nd husband of actress Kelly Rutherford. The couple now is in the process of a divorce. Daniel Giersch filed for legal separation the same day when Kelly Rutherford, who played Lily van der Woodsen in Gossip Girls, submitted her own divorce papers, according to People. The German-born internet entrepreneur was famously known his win against Google for the Gmail trademark lawsuit in Germany. With Kelly, Giersch fathered a son and an unborn baby whom was just conceived three months ago.

Gossip Girl actress Kelly Rutherford’s second marriage has been spoiled, to the extent even the pregnancy can not save it. The 40-year-old filed divorce papers from German millionaire Daniel Giersch, her husband of two years, at Los Angeles Superior Court in California on Dec. 30. She cited irreconcibale differences as the divorce reason. Three-month pregnant Kelly Rutherford and Daniel Giersch (photos 1, 2, 3 4,) have a 2-year-old son, Hermes Gustaf, a joint custody is expected to seek. Rutherford’s first husband was Carlos Tarajano. Their marriage was dissolved back in 2001 after only five months.
